Unless it is a Florida matter I'm sorry but we can't help. You should find an attorney in the area that your father is living. If he is living in SW Florida area we might be able to help. Please call our office 239-334-1141.

I believe your mother - provided she is a resident of the UK - needs to have a UK attorney answer these questions.

That depends upon many factors. If the decedent is in Florida, there is no estate tax here so the only possible estate tax return would be a federal return. The current exemption is $5 million, but prior gifts need to be accounted for so even if the gross estate is less than $5 million, there may be a reporting requirement. You should visit with competent counsel in the decedent's area.

A trustee has a fiduciary responsibility to the beneficiaries of the trust. The fact that the trustees are business partners really should not be a factor, other than it could taint the trustees' actions as self dealing. You should visit with a competent attorney in the jurisdiction of the trust administration.

I found this article very helpful and interesting. Our family have exactly this issue with my brother who lives in Florida, as do I. He is an alcoholic. My mother is estate planning but lives in the UK. Do you know whether these provisions can also be made in the UK? Any advice would be very appreciated - I have emailed this article to my mother also and if this isnt possible in the UK - is it possible to have a valid will that covers US beneficiaries with these stipulations if you reside in the UK?

Thanks

I'm having problems with a 3 trustees that are also beneficiaries, and my brothers. I am not a trustee but a beneficiary. the trust was not terminated at date of the bilaws, and 2 of the brothers are business partners and gave land to each other that was trust property. What law would apply to business partners as trustees? I know there would be no ability to conduct business fairly as in the intrest of the other beneficiaries. This is an irrevocable trust that is worth 2 million plus.. I need a real attorney.

Suppose one died in 2011, what are the rules for reporting estate holdings and step-up values.
I would appreciate knowing what has to be filed and when. Thanks

when does the lookback period change from 36 to 60 months to determine eligibility for Medicaid nursing home care in Florida. Is it February 2006 or November 2007?

Some references say December 2010.

Thank you
